Terms of Use of KlebPhaCol Phage and Bacterial Strain Collection
Introduction
Welcome to the Klebsiella Phage and Bacterial Strain Collection ("KlebPhaCol"). By accessing and using the strains from KlebPhaCol, you ("the Receiver") agree to adhere to the following terms and conditions. These terms are formulated to ensure that the benefits from the findings and data resulting from the use of our collection are shared with the entire scientific community.
1. Purpose and Scope
KlebPhaCol is intended primarily for academic research, and educational purposes. The use of strains from KlebPhaCol for commercial purposes without our prior written consent is strictly prohibited.
2. Data Sharing Agreement
2.1. Mandatory Sharing: The Receiver agrees to share any and all data obtained as a result of using the KlebPhaCol collection with the wider scientific community. This encompasses genomic, phenotypic, and experimental data.
2.2. Publication Platform: Initial data should be promptly uploaded to an open platform like Figshare, ensuring instant recognition and accessibility to the global scientific community.
2.3. Periodic Publication: We will prepare a consolidated report of findings that will undergo peer review and be published in a recognized society journal every five years. The Receiver's contributions will be acknowledged and credited in this publication.
3. Intellectual Property and Recognition
3.1. Immediate Recognition: Upon sharing initial data on an open platform, the Receiver will be recognized immediately for their contributions.
3.2. Co-authorship: Significant contributions, such as any experimental and genomic data shared with the Collection, will earn the contributor’s co-authorship in the consolidated five-yearly publication.
4. Use in Phage Therapy
4.1. Receiver's Responsibility: The Receiver acknowledges that any use of the KlebPhaCol collection in Phage Therapy is solely their responsibility.
4.2. Health Agency Consultation: The collection does not endorse or support the use of its strains in Phage Therapy without proper consultation with and approval from the respective country's health agency and in compliance with local laws.
5. Prohibited Uses and Consequences
5.1. Restricted Activities: Commercial, illegal, or unethical activities, or any action that contravenes the principles of scientific integrity, are strictly prohibited.
5.2. Legal Consequences: Misuse of the KlebPhaCol collection will lead to legal action. Offenders will be prosecuted in a UK court of law.
6. Termination and Sanctions
Failure to abide by these terms can result in immediate termination of access to KlebPhaCol and potential sanctions, which may include exclusion from future publications and communication of the breach to relevant institutions and authorities.
7. Amendments
We reserve the right to update or change these terms at any moment. Continued use of KlebPhaCol post any modifications denotes acceptance of the revised terms.
8. Governing Law
These terms are governed and construed under UK law.
